Psycho-Legal & Forensic Evaluations

Francois de Marigny is a clinical psychologist in Morningside, Durban, who conducts psycho-forensic evaluations and gives expert testimony. He has worked in KwaZulu-Natal, Gauteng, the Western Cape and Zimbabwe since the early 1990s, and matters in which he provided expert testimony have been reported in the South African Law Reports. His evaluations cover family law, including care and contact, relocation and parental alienation, as well as criminal matters and personal injury.

I have been conducting psycho-forensic evaluations and providing expert testimony in KwaZulu-Natal, Gauteng, Western Cape and Zimbabwe since the early 1990’s. Numerous matters, in which I have provided expert testimony, have been reported in the South African Law Reports.

Forensic psychology (also known as psycho-legal evaluation), is where psychology and the law intersect. It involves an understanding of family law, criminal law and other legal disciplines relating to personal injury and labour disputes. The Forensic Psychologist assists the Court by providing psychological information, reports and by giving evidence during a trial.

I maintain a high degree of ethical impartiality in conducting the evaluations and providing opinions. Where children are involved, assessments are conducted in a sensitive and child-friendly environment. I have over 35 years of experience in the field of psycho-forensics.

The main areas of focus in which I am involved are:

  • Evaluations of possible malingering
  • Curatorship evaluations
  • Child custody (care and contact) evaluations in divorce matters.
  • Identifying parental alienation or alignment when children become embroiled in the divorce process and develop a strong collusion with one parent at the expense of their relationship with the other.
  • Relocation evaluations where, by virtue of a parent’s relocation, the children may be separated from the other parent for extended periods of time.
  • Competency to stand trial
  • Assessment of personal injury
  • Specialised forensic personality assessment
  • Assisting couples to compile parenting plans

Psycho-forensic evaluations are not covered by medical aids. Fees are available on request — see fees. For mediation and parenting coordination, see Mediation, Parenting Coordination & Family Conflict Resolution.

Common questions

What is the difference between mediation and a psycho-legal evaluation?

Mediation is collaborative and voluntary — the psychologist helps you and the other parent reach your own agreement, and takes no position on who is right. A psycho-legal evaluation is an assessment conducted for a court, in which the psychologist forms and states an independent opinion. In mediation he works for both of you. In an evaluation he works for the court.

Who pays for a psycho-legal evaluation?

This is usually set out in the court order or agreed between the parties' attorneys, and is commonly shared between the parties. These evaluations are not covered by medical aids. Fees are quoted on request once the scope of the mandate is clear.

What is parental alienation?

It describes children becoming embroiled in the divorce process and developing a strong collusion with one parent at the expense of their relationship with the other. Identifying alienation or alignment is one of the areas of psycho-forensic evaluation.
